Judge Rejects Act 250 Permit Request for F-35s

A judge has rejected the request of an Act 250 permit to house the fighter jets at the Vermont Air Natural Guard base.
BURLINGTON, Vt. - A judge has rejected the request of an Act 250 permit to house the fighter jets at the Vermont Air Natural Guard base. Vermont Superior Court Environmental Division Judge Thomas Walsh made the decision Tuesday. 

Court documents say that since there is not physical changes being done to the runway or use of the runway, an ACT 250 permit is not required.

Opponents who filed the request for the ACT 250 permit say they will either file a motion to reconsider or will appeal the judge's decision.  

The first F-35s are scheduled to arrive at the base in 2020.
