Man Accused of Killing Burlington, VT Woman 3 Years Ago Yet to be Tried

As we near the anniversary of a Burlington woman's death, the man accused of killing her, has has yet to be tried.
BURLINGTON, Vt. - As we near the anniversary of a Burlington woman's death, the man accused of killing her, has has yet to be tried.

50-year old Kathleen Smith, a social worker, was found dead in her home in October 2010.

Prosecutors charged now 48-year old Jose Pazos. Why the hold-up? The court must rule on whether he's competent to stand trial. According to a doctor's report, he isn't.

So far there hasn't been an official ruling. Prosecutors say Pazos has also expressed interest in representing himself.

"There's a large volume of evidence that supports a conviction of Mr. Pazos and links him to the crime, links him to Ms. Smith," Justin Jiron, Vermont Deputy State's Attorney, said. "I don't like to characterize how strong a case it is but we certainly have nothing to change now from 3 years ago."

In the next few weeks, the court will decide whether to appoint Jose Pazos a guardian during the competency process.
