Owen Labrie, the prep school graduate convicted of sexually assaulting a classmate, will get his appeal heard by the New Hampshire Supreme Court, according to court documents filed Monday.

In April, Labrie’s request for a new trial was denied by New Hampshire Superior Court. That request was made in February.  His new lawyer said the original lawyers failed to challenge the felony charge.

Labrie was found guilty of using a computer to lure an underage girl to have sex.
